Definitions of Project affected families (PAFs)/ </strong><strong>परियोजना प्रभावित परिवारों की परिभाषाएं</strong><strong>:</strong><br />  <br />                         The definition of Project affected families (PAFs) shall be as per definition provided in the “Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013” and subsequent  amendments, if any.<br /> <br />                        The definition of Project affected families (PAFs) in relation to land acquired for NHPC is as below:<br /> <br />परियोजना प्रभावित परिवारों (पीएएफ) की परिभाषा "भूमि अधिग्रहण, पुनर्वास और पुनर्वास अधिनियम, 2013 में उचित मुआवजे और पारदर्शिता का अधिकार" और बाद में संशोधन, यदि कोई हो, में प्रदान की गई परिभाषा के अनुसार होगी।.<br /> <br /> <br />                   एनएचपीसी के लिए अधिग्रहित भूमि के संबंध में परियोजना प्रभावित परिवारों (पीएएफ) की परिभाषा नीचे दी गई है::<br /> <ol ><li> a  family whose land or other immovable property has been acquired by NHPC Limited for Teesta-V Power Station Purpose.</li></ol>एक परिवार जिसकी भूमि या अन्य अचल संपत्ति एनएचपीसी लिमिटेड द्वारा तीस्ता-V पावर स्टेशन प्रयोजन के लिए अधिग्रहित की गई है.<ol ><li>a  family which does not own any land but a member or members of such family may be agricultural labourers, tenants including any form of tenancy or holding of usufruct right, share-croppers or artisans or who may be working in the affected are for three years prior to the acquisition of the land, whose primary source of livelihood stand affected by the acquisition of land;</li></ol>एक परिवार के परिवार के लिए जमीन, ऐसे परिवार के सदस्य या किसान खेत में काम करने वालों में अन्य प्रकार की सुविधाएं या सूदखोरी का अधिकार भी शामिल हो सकता है, वे हैं, वे हैं;<ol ><li>   the Scheduled Tribes and other traditional forest dwellers who have lost any of their forest rights recognized under the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Right) Act, 2006 due to acquisition of land;</li></ol>अनुसूचित जनजाति और अन्य पारंपरिक वन निवासी जिन्होंने भूमि के अधिग्रहण के कारण अनुसूचित जनजाति और अन्य पारंपरिक वन निवासी (वन अधिकार की मान्यता) अधिनियम, 2006 के तहत मान्यता प्राप्त अपने किसी भी वन अधिकार को खो दिया है;<ol ><li>   family whose primary source of livelihood for three years prior to acquisition of land is dependent on forests  or water bodies and includes gatherers of forest produce, hunters, fisher folk and boatman and such livelihood is affected due to acquisition of land;</li></ol>परिवार जिनकी आजीविका का प्राथमिक स्रोत भूमि अधिग्रहण से पहले तीन साल तक वनों या जल निकायों पर निर्भर है और इसमें वन उपज, शिकारी, मछुआरे और नाविक शामिल हैं और ऐसी आजीविका भूमि के अधिग्रहण के कारण प्रभावित होती है;<ol ><li>  a member of the family who has been assigned land by the State Government or the Central Government under  any of its  schemes  and such land is under acquisitions;</li></ol>परिवार का एक सदस्य जिसे राज्य सरकार या केंद्र सरकार द्वारा अपनी किसी भी योजना के तहत भूमि आवंटित की गई है और ऐसी भूमि अधिग्रहण के अधीन है;<ol ><li> a family residing on any land in the urban areas for preceding three years or more prior to the acquisition of the land or whose primary  source of livelihood for three years  prior to the acquisition of the land is affected by the acquisition of such land.</li></ol>शहरी क्षेत्रों में किसी भी भूमि पर रहने वाला परिवार भूमि के अधिग्रहण से पहले तीन साल या उससे अधिक समय तक रहता है या जिसकी आजीविका का प्राथमिक स्रोत भूमि के अधिग्रहण से तीन साल पहले ऐसी भूमि के अधिग्रहण से प्रभावित होता है।.<br /> <br />                          <strong>B. Definitions of Locals / </strong><strong>स्थानीय लोगों की परिभाषाएं</strong><strong>:</strong><br /> <br /><strong>“</strong><strong><em>The geographical limits for defining the local residents eligible under the policy for reservation of works to be awarded on Local Competitive Bidding Basis to PAFs and Locals residing near to Teesta-V Power Station shall be East, North & South Districts of Sikkim</em></strong><strong><em>.”</em></strong><br />“तीस्ता-V पावर स्टेशन के पास रहने वाले पीएएफ और स्थानीय लोगों को स्थानीय प्रतिस्पर्धी बोली के आधार पर दिए जाने वाले कार्यों के आरक्षण के लिए नीति के तहत पात्र स्थानीय निवासियों को परिभाषित करने की भौगोलिक सीमा सिक्किम के पूर्व, उत्तर और दक्षिण जिले होंगे।.<br /> <br /><strong>The value of works and services to be awarded to any single entity at any point of time shall be limited to Rs. 125 Lakhs (Rupees One Hundred Twenty Five Lac).</strong><br />किसी एक इकाई को किसी भी समय दिए जाने वाले कार्यों और सेवाओं का मूल्य <strong>125.00 लाख</strong> (एक सौ पच्चीस लाख रुपये) तक सीमित होगा.<br /> <br /><strong>C. Who are eligible for reservation? /</strong><strong>आरक्षण के लिए कौन पात्र हैं</strong><strong>?</strong><br /> <ol ><li><strong>  PAFs, Individuals, Partnership firms, Group of people in the form of Cooperative societies/Self Help Groups (SHGs) )/Companies (having 100% beneficiaries from the category of PAF/Locals) by Locals from the notified area will only be considered under policy for award of the reserved works/services</strong></li></ol> <br /><strong>The eligibility of PAF to Participate in the tenders shall be considered taking into account the work awarded to PAF’s family as a whole. The person, his family along with legal heirs shall be considered as single PAF. Declaration in this regard shall be provided by the PAF. In case of false declaration, the concerned PAF shall be debarred from participation of tenders for six months</strong><br /> <br /><strong>परियोजना प्रभावित परिवारों</strong><strong>, </strong><strong>व्यक्तियों</strong><strong>, </strong><strong>साझेदारी फर्मों</strong><strong>, </strong><strong>सहकारी समितियों/स्वयं सहायता समूहों (एसएचजी) के रूप में लोगों के समूह/कंपनियां (जिनके 100% लाभार्थी परियोजना प्रभावित परिवारों/स्थानीय लोगों की श्रेणी से हों) को ही अधिसूचित क्षेत्र के स्थानीय लोगों द्वारा आरक्षित कार्यों/सेवाओं के लिए नीति के तहत विचार किया जाएगा।।</strong><strong>.</strong><br /> <br /><strong>निविदाओं में भाग लेने के लिए परियोजना प्रभावित व्यक्तियों की पात्रता पर परियोजना प्रभावित व्यक्तियों के परिवार को दिए गए कार्य को ध्यान में रखते हुए विचार किया जाएगा। व्यक्ति</strong><strong>, </strong><strong>उसके परिवार के साथ-साथ कानूनी उत्तराधिकारियों को एकल परियोजना प्रभावित व्यक्तियों के रूप में माना जाएगा। परियोजना प्रभावित व्यक्तियों द्वारा इस संबंध में घोषणा पत्र प्रस्तुत किया जाएगा। गलत घोषणा के मामले में</strong><strong>, </strong><strong>संबंधित परियोजना प्रभावित व्यक्तियों को छह महीने के लिए निविदाओं में भाग लेने से वंचित कर दिया जाएगा।</strong><br /> <br /> <ol ><li><strong>The provision regarding Public Procurement (Preference to Make in India) Order-2017, Restrictions under Rule 144 (xi) of the General Financial Rule (GFRs) 2017, Micro and Small Enterprises and Startups as amended from time to time shall be applicable for this policy. The owner of MSMEs/Startups shall from the entities mentioned at Sl. No. C (i) above.</strong></li></ol> <br /><strong>सार्वजनिक खरीद (मेक इन इंडिया को वरीयता) आदेश-</strong><strong>2017, </strong><strong>सामान्य वित्तीय नियम (जीएफआर) </strong><strong>2017 </strong><strong>के नियम </strong><strong>144 (xi) </strong><strong>के तहत प्रतिबंध</strong><strong>, </strong><strong>सूक्ष्म और लघु उद्यम तथा स्टार्टअप्स के संबंध में समय-समय पर संशोधित प्रावधान इस नीति के लिए लागू होंगे। एमएसएमई/स्टार्टअप्स के मालिक उपरोक्त क्रमांक सी (</strong><strong>i) </strong><strong>में उल्लिखित संस्थाओं से होंगे।</strong><br /> <ol ><li><strong>At a time not more than four works/ services shall be allotted/ awarded to the same entity</strong><strong>.</strong></li></ol> <br /><strong>एक समय में एक ही इकाई को चार से अधिक कार्य/सेवाएं आवंटित/प्रदान नहीं की जाएंगी।</strong><strong>.</strong><br /><strong>2.2.1.5 Performance monitoring: In case any contractor does not perform as per the requirement of contract, the contract would be terminated without any consequences to the contractor and he will be debarred from participating in the tender under policy for Two Years from date of termination.</strong><br /> <br /><strong>प्रदर्शन की निगरानी: यदि कोई ठेकेदार अनुबंध की आवश्यकता के अनुसार प्रदर्शन नहीं करता है</strong><strong>, तो ठेकेदार को बिना किसी परिणाम के अनुबंध समाप्त कर दिया जाएगा और उसे समाप्ति की तारीख से दो साल के लिए नीति के तहत निविदा में भाग लेने से वंचित कर दिया जाएगा।.</strong><br /> <br /> <ol><li>All Start-ups (whether MSEs or otherwise), falling within the definition as per Gazette notification- G.S.R. 501(E) dt. 23.05.2017 or as amended from time to time are exempted from meeting the qualification criteria in respect of Prior Experience-Prior Turnover subject to their meeting the quality and technical specification. However, the Employer reserves the right to deny such exemptions to Start-ups (whether MSEs or otherwise) in case of circumstances like procurement of items related to public safety, health, critical security operations and equipments etc. Declaration in this regard is to be submitted by the Bidder as per Annexure-VIII. (<strong>Note: Udyam registration (Major activity-Service) shall be the ONLY valid MSME registration document.)</strong></li></ol> <br />राजपत्र अधिसूचना के अनुसार परिभाषा के अंतर्गत आने वाले सभी स्टार्ट-अप (चाहे एमएसई हों या अन्यथा), जी.एस.आर. 501 (ई) तारीख 23.05.2017 या समय-समय पर यथा संशोधित पूर्व अनुभव-पूर्व टर्नओवर के संबंध में योग्यता मानदंडों को पूरा करने से छूट दी गई है, बशर्ते कि वे गुणवत्ता और तकनीकी विनिर्देश को पूरा करते हों। हालांकि, नियोक्ता सार्वजनिक सुरक्षा, स्वास्थ्य, महत्वपूर्ण सुरक्षा संचालन और उपकरणों आदि से संबंधित वस्तुओं की खरीद जैसी परिस्थितियों के मामले में स्टार्ट-अप (चाहे एमएसई या अन्यथा) को ऐसी छूट से इनकार करने का अधिकार सुरक्षित रखा है। इस संबंध में बोलीदाता द्वारा अनुबंध-VIII के अनुसार घोषणा करनी होगी। (नोट: उद्यम पंजीकरण (सेवा) ही एकमात्र वैध एमएसएमई पंजीकरण दस्तावेज होगा।)<br /> <br /> <ol><li>All Micro and Small Enterprises (MSEs) are exempted from meeting the qualification criteria in respect of Prior Experience-Prior Turnover in public procurement subject to meeting of quality and technical specifications for which necessary documents shall be submitted by such bidders.
