2.पात्र बिडर / Eligible Bidders
Bidder shall be Class-I Local Supplier under Public Procurement (Preference toMake in India), Order-2017 issued by the Department of Promotion of Industryand Internal Trade (DPIIT), Ministry of Commerce and Industry vide No. P-45021/2/2017-PP (BE-II) dated 16.09.2020 or as amended from time to time.Bidders shall submit undertaking/self-certificate regarding Local content in theformat provided. Bidder shall also give details of the location(s) at which thelocal valueadditionismade.
Public Procurement (Preferences to Make in India) Policy (including its latest modifications/amendments) as may be prevailing on the date of Price Bid Opening shall be applicable against this tender. Bidders are requested to go through the Public Procurement (Preferences to Make in India) policy available on concerned ministry website.
सभी आवेदकों को अपनी बोलियाँ प्रस्तुत करते समय नियोक्ता के साथ सत्यनिष्ठा संधि (सादे कागज पर निष्पादित) करनी होगी। नियोक्ता की ओर से डिजिटल रूप से हस्ताक्षरित/हस्ताक्षरित सत्यनिष्ठा संधि फॉर्म-7 सेक्शन-III के अनुसार होगी। सत्यनिष्ठा संधि को आवेदक द्वारा डाउनलोड, प्रिंट और हस्ताक्षरित किया जाएगा और ऑनलाइन जमा किया जाएगा।
सफल बोलीदाता अनुबंध समझौते पर हस्ताक्षर करने से पहले उचित मूल्य के गैर-न्यायिक स्टाम्प पेपर पर विधिवत निष्पादित सत्यनिष्ठा संधि प्रस्तुत करेगा।
सत्यनिष्ठा संधि के तहत दायित्व के अनुपालन की देखरेख के लिए, (आईईएम का नाम) को नियोक्ता द्वारा स्वतंत्र बाह्य मॉनिटर (आईईएम) के रूप में नियुक्त किया गया है। आईईएम का संपर्क पता इस प्रकार है:
To improve transparency and fairness in the tendering process the Employer isimplementingIntegrity Pact.
The Integrity Pact, signed by all the prospective Bidders and the Employer, shall commit the persons/officials of both the parties, not to exercise any corrupt/ fraudulent/collusive/coercive practices in the Tendering process and also during implementation of the Contract. Only those Bidders who have entered into Integrity Pact with the Employer shall be eligible to participate in the bidding process.
All Applicants shall enter into an Integrity Pact (to be executed on plain paper) with the Employer at the time of submission of their Bids. The Integrity Pact digitally signed / signed on behalf of the Employer shall be as per Form-7 Section-III. The Integrity Pact shall be downloaded, printed and signed by the Applicant and to be submitted online.
Successful bidder shall submit duly executed Integrity pact on Non-Judicial Stamp paper of appropriate value prior to signing of Contract Agreement.

3.बिडर की अर्हता / Qualification of the Bidder
The similarity of work shall be “Any Civil work.”
3.2 D संयुक्त उद्यम या एकमात्र बोलीदाता के अलावा किसी अन्य व्यवस्था की अनुमति नहीं है। प्रस्तावित उप-ठेकेदार के अनुभव और संसाधन, यदि कोई हो, को बोलीदाता द्वारा योग्यता मानदंडों के अनुपालन का निर्धारण करने में ध्यान में नहीं रखा जाएगा। हालांकि, परियोजना डेवलपर द्वारा अनुमोदित उप-ठेकेदार के रूप में बोलीदाता के अनुभव पर विचार किया जाएगा। कंसोर्टियम/संयुक्त उद्यम के सदस्य के रूप में बोलीदाताओं के अनुभव को कंसोर्टियम/संयुक्त उद्यम के सदस्य के विरुद्ध कार्य के वितरण के अनुसार माना जाएगा। ऐसे मामले में जहां कंसोर्टियम/संयुक्त उद्यम सदस्यों का वितरण कंसोर्टियम/संयुक्त उद्यम समझौते में निर्दिष्ट नहीं है, तो न्यूनतम 35% भागीदारी हिस्सेदारी के साथ संयुक्त उद्यम के सभी सदस्यों के लिए अनुभव प्रमाण पत्र पर विचार किया जाएगा।
JVs or any other arrangement other than sole bidder is not allowed. Experience and resources of proposed sub-contractor, if any shall not be taken into account in determining the bidder’s compliance with the qualifying criteria. However, experience of bidder as sub- contractor approved by Project developer shall be considered. Experience of bidders as member of Consortium/Joint Venture shall be considered as per distribution of work against the member of the Consortium/Joint Venture. In case where distribution of Consortium/JV members is not specified in Consortium/JV agreement then the experience credential shall be considered for all members of JV with minimum 35% participation share.
3.2 E राजपत्र अधिसूचना- जीएसआर 127(ई) दिनांक 19.02.2019 या समय-समय पर संशोधित के अनुसार परिभाषा के अंतर्गत आने वाले समान प्रकृति के काम के लिए पंजीकृत सभी स्टार्टअप (चाहे एमएसई हों या अन्य) को पैरा 3.2 ए के अनुसार पूर्व अनुभव-पूर्व टर्नओवर के संबंध में योग्यता मानदंड को पूरा करने से छूट दी गई है, बशर्ते कि वे गुणवत्ता और तकनीकी विनिर्देश को पूरा करते हों। हालाँकि, नियोक्ता सार्वजनिक सुरक्षा, स्वास्थ्य, महत्वपूर्ण सुरक्षा संचालन और उपकरणों आदि से संबंधित वस्तुओं की खरीद जैसी परिस्थितियों के मामले में स्टार्टअप को ऐसी छूट देने से इनकार करने का अधिकार सुरक्षित रखता है।
All Startups (whether MSEs or otherwise) registered for similar nature of work falling within the definition as per Gazette notification- GSR 127(E) dated 19.02.2019 or as amended from time to time are exempted from meeting the qualification criteria in respect of Prior Experience-Prior Turnover as per para 3.2 A subject to their meeting the quality and technical specification. However, the Employer reserves the right to deny such exemptions to Startups in case of circumstances like procurement of items related to public safety, health, critical security operations and equipments etc.
ऐसे बिडर जिसके खिलाफ बीड प्रस्तुत करने समय कॉर्पोरेट इनसॉल्वेन्सी संकल्प कानूनी कार्यवाही स्वीकार नहीं किया गया है परंतु बीड मूल्यांकन के दौरान या वर्क अवार्ड करने से पहले आईबीसी 2016 के अंतर्गत निर्णायक प्राधिकार द्वारा ऐसा कोई आवेदन स्वीकार किया जाता है तो बिडर को अयोग्य मानते हुए उसकी बीड अस्वीकार कर दी जाएगी।
इसके लिए बिडर के अधिकृत प्रतिनिधित द्वारा लेटर हेड पर इस आशय का वचनपत्र देना होगा कि “बिडर के खिलाफ आईबीसी 2016 के अंतर्गत निर्णायक प्राधिकारी द्वारा इनसॉल्वेन्सी की कोई कानूनी कार्यवाही स्वीकार नहीं की गई है।”
इसके अतिरिक्त, बीड प्रस्तुत करने के बाद वर्क अवार्ड होने तक बिडर अपने खिलाफ आईबीसी 2016 के अंतर्गत निर्णायक प्राधिकारी द्वारा कॉर्पोरेट इनसॉल्वेन्सी संकल्प संबंधी कानूनी कार्यवाही की स्वीकृति की सूचना एनएचपीसी को देगा। ऐसे तथ्यों को छुपाए जाने पर बीड डॉक्युमेंट के टर्म एवं कंडीशन के अनुसार बिडर का बीड अविकार कर दिया जाएगा और उसके व्यापारिक व्ययवाहर के लिए प्रतिबंधित कर दिया जाएगा।
The Bidder against whom an application for initiating corporate insolvency resolution process has been admitted by the Adjudicating Authority under the Insolvency and Bankruptcy code 2016 or as amended from time to time shall not be eligible for bidding. The same shall also be applicable to the bidder company who has taken unconditional technical and/or financial support from their Parent/ Holding Company, against whom an application for initiating corporate insolvency resolution process has been admitted by the Adjudicating Authority under the Insolvency and Bankruptcy Code 2016, or as amended from time to time (IBC 2016 hereafter).
In case, bidder in respect of whom any application for initiating corporate insolvency resolution process was not admitted at the time of submission of bid but subsequently during the period of evaluation of bids or any time before the work is awarded, any such application is admitted by the Adjudicating Authority under the IBC 2016, the bidder shall be considered as ineligible and his bid shall be rejected.
An undertaking that “no insolvency proceedings is admitted by the Adjudicating Authority against bidder under the IBC 2016” shall be submitted on letter head duly signed by the authorized representative of bidder.
Further, the bidder after submitting the bid till the time of award of work, shall inform NHPC regarding any admission of application for corporate insolvency resolution process by the Adjudicating Authority under the IBC 2016 against bidder and any suppression of such fact shall render the bidder liable for rejection of his bid and banning of business dealing as per terms and conditions of the Bid Document.
3.3अनर्हता/ Disqualification:
उपर्युक्त अर्हता मानदंडों को पूरा करने के बावजूद बिडर को अयोग्य माना जाएगा यदि वे Even though the bidders meet the above qualifying criteria, they are subject to be disqualified if they have:
4.0 Time for Completion
सफल बिडर क्रम संख्या-1 में उल्लिखित समय सीमा के समस्त कार्य पूरा करेगा जिसकी गणना नियोक्ता द्वारा स्वीकृति पत्र जारी करने की तिथि से की जाएगी।
The successful bidder shall complete the entire work within the time specified at SI no. -1, to be reckoned from the date of issue of Letter of Acceptance issued by the Employer.
5.0 निविदाओं के साथ तालिका में कार्य के लिए निर्दिष्ट राशि की बयाना राशि भी संलग्न होनी चाहिए।
Tenders must be accompanied by the earnest money of the amount specified for the work in the table.
6.0बीड पूर्व बैठक /Pre-Bid Meeting

यदि बोलियों को प्रस्तुत करने के लिए निर्दिष्ट तिथि या संशोधन यदि कोई हो, को नियोक्ता के लिए अवकाश घोषित किया जाता है, तो दस्तावेजों की हार्ड कॉपी अगले कार्य दिवस को निर्दिष्ट समय तक प्राप्त की जाएगी। इसी तरह, यदि बोलियों को खोलने के लिए निर्दिष्ट तिथि या संशोधन यदि कोई हो, को नियोक्ता के लिए अवकाश घोषित किया जाता है, तो बोली को अगले कार्य दिवस को निर्दिष्ट समय पर खोला जाएगा। हालाँकि, बोलियों को ऑनलाइन प्रस्तुत करने की तिथि और समय निर्दिष्ट तिथि और समय या संशोधन यदि कोई हो, के रूप में जारी रहेगा।

In the event of the specified date or amendment if any for the submission of bids being declared a holiday for the Employer, the hard copy of the documents will be received up to the specified time on the next working day. Similarly, in the event of the specified date or amendment if any for the opening of bids being declared a holiday for the Employer, the opening shall be carried out at the specified time on the next working day. However, the date and time for online submission of the Bids shall continue to be the date and time specified or amendment if any.
8.0 बोली के लिए मुद्रा केवल भारतीय रुपया होगी।
The currency for the Bid shall be Indian Rupee only.
9.0 बोलियाँ बोली प्रस्तुत करने की अंतिम तिथि के बाद क्रम संख्या 1 में उल्लिखित अवधि के लिए वैध होंगी। यदि कोई बोलीदाता उक्त अवधि से पहले अपनी बोली वापस लेता है या अपनी बोली में कोई संशोधन करता है, तो बोलीदाता की बयाना राशि जब्त कर ली जाएगी। बोली वैधता अवधि समाप्त होने से पहले, नियोक्ता बोलीदाताओं से बोली वैधता अवधि बढ़ाने का अनुरोध कर सकता है। अनुरोध और प्रतिक्रिया लिखित रूप में की जानी चाहिए। बोली वैधता अवधि का विस्तार बोलीदाता को अपनी बोली संशोधित करने का अधिकार नहीं देगा। यदि बोलीदाता नियोक्ता के अनुरोध पर बोली वैधता बढ़ाने में विफल रहता है, तो संबंधित बोली को गैर-उत्तरदायी मानकर अस्वीकार कर दिया जाएगा।
Bids shall be valid for a period as mentioned in Sl no. 1 after the deadline for Bid submission. If any Bidder withdraws his Bid before the said period or makes any modification in his Bid, the Earnest Money deposit of the Bidder shall be forfeited. Prior to the expiry of bid validity period, Employer may request Bidders to extend the Bid validity period. The request and the response shall be made in writing. An extension of the bid validity period will not entitle a Bidder to modify its Bid. In case Bidder fails to extend the bid validity upon employer’s request, the corresponding Bid shall be rejected as being non-responsive.
10.0 तकनीकी-वाणिज्यिक बोली क्रम संख्या-1 के अनुसार स्थल की तिथि और समय पर ऑनलाइन खोली जाएगी। योग्य बोलीदाताओं की वित्तीय बोली खोलने का समय और तिथि तकनीकी बोलियों के मूल्यांकन के बाद बाद में पोर्टल के माध्यम से सूचित की जाएगी। नियोक्ता/निविदा आमंत्रित करने वाला प्राधिकारी अपने विवेक से तकनीकी और वित्तीय बोली एक साथ खोल सकता है और बोली का पूर्ण मूल्यांकन कर सकता है।
The Techno-commercial Bid shall be opened online at venue date & time as per Sl. No.-1. the time and date of opening of Financial Bid of bidders qualified the technical bid shall be communicated through portal at later date after evaluations of technical bids. The Employer/Tender inviting Authority at his discretion may open Technical and Financial Bid simultaneously and evaluate the Bid completely.
11.0 नियोक्ता राष्ट्रीय सुरक्षा के मद्देनजर संवेदनशील क्षेत्र और सीमावर्ती क्षेत्रों में स्थित परियोजना में किसी भी रूप में भाग लेने वाली विदेशी कंपनियों और उनके कर्मचारियों पर कुछ प्रतिबंध लगा सकता है। नियोक्ता को ऐसी कंपनी की योग्यता निर्धारित करने से पहले सुरक्षा निहितार्थों के बारे में भारत सरकार से मंजूरी लेनी होगी। इसके अलावा, भारत के साथ भूमि सीमा साझा करने वाले देशों के बोलीदाताओं को व्यय विभाग, वित्त मंत्रालय, भारत सरकार के कार्यालय ज्ञापन संख्या F.No. 6/18/2019/PPD दिनांक 23.07.2020 और 24.07.2020 का अनुपालन करना होगा।
The Employer may impose certain restrictions on the foreign companies participating in any form and their employees in view of the National Security, in the Project situated in the sensitive region and border areas. The Employer shall obtain clearance of Govt. of India regarding security implications prior to qualification of such company. Further, bidders from countries, which share land border with India, shall comply with Department of Expenditure, Ministry of Finance, GoI, OM No. F.No. 6/18/2019/PPD dt. 23.07.2020 & 24.07.2020.
12.0 बोलियाँ प्रस्तुत करने के लिए कोई भी शुद्धिपत्र, बाद में संशोधन और / या तिथि का विस्तार, यदि कोई हो, पोर्टल https://eprocure.gov.in/eprocure/app पर पोस्ट किया जाएगा। बोलीदाताओं को सलाह दी जाती है कि वे बोलियाँ प्रस्तुत करने की अंतिम तिथि से पहले नियमित रूप से पोर्टल पर जाएँ।
Any corrigendum, subsequent amendments and / or extension of date, if any, for submission of Bids shall be posted on the portal https://eprocure.gov.in/eprocure/app. Bidder(s) are advised to visit the portal regularly before the deadline for submission of Bids.
13.0 नियोक्ता किसी भी बोली को स्वीकार या अस्वीकार करने तथा बोली प्रक्रिया को रद्द करने और सभी बोलियों को अस्वीकृत करने का अधिकार सुरक्षित रखता है, अनुबंध दिए जाने से पहले किसी भी समय, प्रभावित बोलीदाता या बोलीदाता(ओं) के प्रति कोई दायित्व वहन किए बिना। हालाँकि, जो बोलीदाता(ओं) रद्दीकरण/अस्वीकृति के ऐसे निर्णय के लिए कारण जानना चाहते हैं, उन्हें नियोक्ता द्वारा इसकी सूचना दी जाएगी, जब तक कि इसके प्रकटीकरण से भारत की संप्रभुता और अखंडता, राज्य की सुरक्षा, रणनीतिक, वैज्ञानिक या आर्थिक हित प्रभावित होने या किसी अपराध को बढ़ावा देने की संभावना न हो।
The employer reserves the right to accept or reject any Bid and to cancel the Bidding process and reject all Bids, at any time prior to the award of Contract, without thereby incurring any liability to the affected Bidder or Bidder(s). However, the Bidder(s) who wish to seek reasons for such decision of cancellation/rejection shall be informed of the same by Employer unless its disclosure reasonably could be expected to affect the sovereignty and integrity of India, the security, strategic, scientific or economic interest of the state or lead to incitement of an offence.

2.पात्र बिडर / Eligible Bidders
- बीड के लिए यह आमंत्रण खुला है /This Invitation for Bid is open to:
- बिडर जो निगमित वैध इकाई हैं तथा कानूनी एवं वित्तीय रूप से स्वायत्त हैं और अपने क्षेत्राधिकार के वाणिज्यक कानूनों के तहत संचालित हैं।
- सभी बिडर क्लॉज़ 3 में वर्णित अर्हता मानदंडों को पूरा करते हों।
- उद्योग एवं आंतरिक व्यापार संवर्धन विभाग (डीपीआईआईटी), वाणिज्य एवं उद्योग मंत्रालय के P-45021/2/2017-PP (BE-II), दिनांक 16.09.2020 द्वारा जारी एवं समय-समय पर संशोधित सार्वजनिक खरीद (मेक इन इंडिया को प्राथमिकता) आदेश-2017 के तहत बिडर क्लास-I लोकल सप्लायर होगा। बिडर को संलग्न फॉर्मेट में लोकल कंटेन्ट संबंधी वचन-पत्र/स्व-प्रमाणपत्र प्रस्तुत करेगा। बिडर उन लोकेशन्स का विवरण भी देगा जहां लोकल वैल्यू एडीशन किया गया है।
Bidder shall be Class-I Local Supplier under Public Procurement (Preference toMake in India), Order-2017 issued by the Department of Promotion of Industryand Internal Trade (DPIIT), Ministry of Commerce and Industry vide No. P-45021/2/2017-PP (BE-II) dated 16.09.2020 or as amended from time to time.Bidders shall submit undertaking/self-certificate regarding Local content in theformat provided. Bidder shall also give details of the location(s) at which thelocal valueadditionismade.
Public Procurement (Preferences to Make in India) Policy (including its latest modifications/amendments) as may be prevailing on the date of Price Bid Opening shall be applicable against this tender. Bidders are requested to go through the Public Procurement (Preferences to Make in India) policy available on concerned ministry website.
- बिडर को व्यय विभाग, वित्त मंत्रालय द्वारा 23.07.2020 को जारी “सामान्य वित्तीय नियम (जीआरएफ)2017 के नियम 144(xi) के प्रतिबंधों” के प्रावधानों एवं अनुवर्त्ति संशोधनों का अनुपालन करना होगा।
- बोलीदाताओं को बोली प्रस्तुत करते समय सत्यनिष्ठा संधि के लिए व्यापारिक सौदों पर प्रतिबंध लगाने संबंधी दिशा-निर्देशों (अनुलग्नक-ए) के पैरा 6 में उल्लिखित आधार पर व्यवसाय से प्रतिबंध / सूची से बाहर करना / काली सूची में डालना / निषिद्ध करना अयोग्य घोषित नहीं किया जाएगा और बोली प्रस्तुत करने के बाद निविदा दिए जाने तक किसी भी प्रतिबंध / सूची से बाहर करना / काली सूची में डालना / निषिद्ध करना तुरंत सूचित करना होगा। इस संबंध में स्व-घोषणा संलग्न प्रोफार्मा (फॉर्म-6-, खंड-III) के अनुसार प्रस्तुत की जानी है।
- जिन बोलीदाताओं के अनुबंध को नियोक्ता द्वारा अतीत में असंतोषजनक प्रदर्शन के कारण समाप्त कर दिया गया है, उन्हें अपात्रता अवधि पूरी होने तक बोली प्रक्रिया में भाग लेने की अनुमति नहीं दी जाएगी।
- निविदा प्रक्रिया में पारदर्शिता और निष्पक्षता में सुधार करने के लिए नियोक्ता सत्यनिष्ठा संधि को लागू कर रहा है।

To improve transparency and fairness in the tendering process the Employer isimplementingIntegrity Pact.
The Integrity Pact, signed by all the prospective Bidders and the Employer, shall commit the persons/officials of both the parties, not to exercise any corrupt/ fraudulent/collusive/coercive practices in the Tendering process and also during implementation of the Contract. Only those Bidders who have entered into Integrity Pact with the Employer shall be eligible to participate in the bidding process.
All Applicants shall enter into an Integrity Pact (to be executed on plain paper) with the Employer at the time of submission of their Bids. 3.बिडर की अर्हता / Qualification of the Bidder
- जब तक आईटीबी में अन्यथा नहीं कहा जाता तब तक सभी बिडर अपने बीडींग अर्हता डॉक्युमेंट में निम्नलिखित सूचनाएं एवं डॉक्युमेंट शामिल करेंगे :
- गठन या कानूनी स्थिति दर्शानेवाले मूल कागजात, पंजीकरण स्थल, व्यवसाय का मूल स्थान, बिडर को प्रतिबद्ध करनेवाला बीड हस्ताक्षर करनेवाले का लिखित पावर ऑफ अटर्नी की प्रतियां। फॉर्म-1, सामान्य जानकारी, सेक्शन-III में मांगी गई अतिरिक्त सूचना।
- क्लॉज़ 3.2 A (b) में निर्धारित मानदंडों के अनुरूप कार्यानुभव रिकॉर्ड फार्म-3, सेक्शन-III में कार्यानुभव देना होगा। दर्शाए गया कार्यानुभव के साथ संबंधित कार्य के अभियंता प्रभारी/प्रोजेक्ट हेड का प्रमाणपत्र लगा होना चाहिए। प्राइवेट संगठन में किए गर कार्यों का कार्यानुभव प्रस्तुत करने की स्थिति में कार्यानुभव प्रमाणपत्र के साथ टीडीएस प्रमाणपत्र/फॉर्म 26AS/वार्षिक सूचना विवरणी (एआईएस) भी प्रास्तुत करना होगा।
- क्लॉज़ 3.2A(a) में निर्धारित वित्तीय मानदंड संबंधी सूचना फॉर्म-4, वार्षिक कंस्ट्रक्शन टर्नओवर, सेक्शन-III में दिया जाएगा। विगत तीन वर्षों के वार्षिक कंस्ट्रक्शन टर्नओवर वाले सीए के शपथपत्र/प्रमाणपत्र की प्रति। यथा स्थिति विगत तीन वर्षों का बिडर का बैलेंस शीट, प्रॉफ़िट एवं लॉस स्टेटमेंट, एवं ऑडिटर्स रिपोर्ट जैसी बिडर की वित्तीय विवरणी या प्रिंटेड वार्षिक रिपोर्ट की प्रति बिडर द्वारा वित्तीय मानंदण्डों को पूरा करके के प्रमाण के रूप में देना होगा। गजट नोटिफिकेशन संख्या 1-CA(7)/192/2019 दिनांक 02.08.2019 के अनुरूप सीए सर्टिफिकेट में युनीक डॉक्युमेंट आइडेंटिफिकेशन नंबर (यूडीआइएन) होना चाहिए।

- प्रस्तावित कार्यप्रणाली (अनुसूची-जी अलग शीट में) और निर्माण कार्यक्रम (अनुसूची-ई में), उपकरण योजना और तैनाती (अनुसूची-एफ में) के साथ समर्थित, व्यापक गणनाओं के साथ विधिवत समर्थित, तकनीकी विनिर्देशों के अनुसार और पूरा होने की निर्धारित अवधि के भीतर कार्य के निष्पादन और पूरा करने की उनकी क्षमता को उचित ठहराते हुए।
- A अनुबंध प्रदान करने के लिए अर्हता प्राप्त करने के लिए प्रत्येक बोलीदाता के पास निम्नलिखित होना चाहिए:

- पिछले तीन वर्षों में किसी एक वर्ष में न्यूनतम वार्षिक निर्माण टर्नओवर कार्य की अनुमानित लागत के बराबर अर्थात 8.53 लाख रुपये प्राप्त किया हो जिसके लिए बोली आमंत्रित की गई है।
- पिछले तीन वर्षों में किसी एक वर्ष में न्यूनतम वार्षिक निर्माण टर्नओवर कार्य की अनुमानित लागत के बराबर अर्थात 8.53 लाख रुपये प्राप्त किया हो जिसके लिए बोली आमंत्रित की गई है।
- आवेदन आमंत्रित किए जाने वाले महीने से पहले के महीने के अंतिम दिन को समाप्त होने वाले पिछले सात वर्षों में, कम से कम एक समान कार्य जिसकी लागत कार्य की अनुमानित लागत के 6.83 लाख रुपये के बराबर राशि से कम नहीं हो या दो समान कार्य जिसकी लागत कार्य की अनुमानित लागत के 4.27 लाख रुपये के बराबर राशि से कम नहीं हो या तीन समान कार्य जिसकी लागत कार्य की अनुमानित लागत के 3.41 लाख रुपये के बराबर राशि से कम नहीं हो। समान कार्य की लागत का पता लगाने के लिए, निष्पादित कार्य के मूल्य को कार्य के वास्तविक मूल्य में प्रति वर्ष सात प्रतिशत की साधारण दर से वृद्धि करके वर्तमान लागत स्तर पर लाया जाएगा, जिसकी गणना पूर्णता की तिथि से बोली खुलने की तिथि तक की जाएगी। कार्य की समानता "कोई भी सिविल कार्य" होगी।

- B प्रत्येक बोलीदाता को अपनी बोली के साथ निम्नलिखित दस्तावेज भी प्रस्तुत करने होंगे:

- पैन, जीएसटी पंजीकरण संख्या, ईपीएफ पंजीकरण संख्या और ईएसआईसी पंजीकरण संख्या (जैसा लागू हो) की प्रतियां।
- फॉर्म-5, घोषणा पत्र, धारा-III में यह घोषणा कि बोली दस्तावेजों के साथ दी गई जानकारी सभी प्रकार से सही है।
- आईटीबी में परिभाषित ऐसे अन्य प्रमाण पत्र, यदि कोई हों।
- C एनआईटी में आमंत्रित बीड हेतु अर्हता प्राप्त करने के लिए बिडर को कार्यानुभव, वित्तीय क्षमता एवं कुल अर्हता मानदंडों को पूरा करने के लिए पर्याप्त संसाधनों को दिखाना होगा। क्लॉज़ 3.1 एवं 3.2 (A) & (B) के डॉक्युमेंट और प्रमाणपत्रों को प्रस्तुत नहीं करने पर बीड को गैर-उत्तरदायी माना जाएगा।
3.2 D संयुक्त उद्यम या एकमात्र बोलीदाता के अलावा किसी अन्य व्यवस्था की अनुमति नहीं है। प्रस्तावित उप-ठेकेदार के अनुभव और संसाधन, यदि कोई हो, को बोलीदाता द्वारा योग्यता मानदंडों के अनुपालन का निर्धारण करने में ध्यान में नहीं रखा जाएगा। हालांकि, परियोजना डेवलपर द्वारा अनुमोदित उप-ठेकेदार के रूप में बोलीदाता के अनुभव पर विचार किया जाएगा। कंसोर्टियम/संयुक्त उद्यम के सदस्य के रूप में बोलीदाताओं के अनुभव को कंसोर्टियम/संयुक्त उद्यम के सदस्य के विरुद्ध कार्य के वितरण के अनुसार माना जाएगा। ऐसे मामले में जहां कंसोर्टियम/संयुक्त उद्यम सदस्यों का वितरण कंसोर्टियम/संयुक्त उद्यम समझौते में निर्दिष्ट नहीं है, तो न्यूनतम 35% भागीदारी हिस्सेदारी के साथ संयुक्त उद्यम के सभी सदस्यों के लिए अनुभव प्रमाण पत्र पर विचार किया जाएगा।
JVs or any other arrangement other than sole bidder is not allowed. Experience and resources of proposed sub-contractor, if any shall not be taken into account in determining the bidder’s compliance with the qualifying criteria. However, experience of bidder as sub- contractor approved by Project developer shall be considered. Experience of bidders as member of Consortium/Joint Venture shall be considered as per distribution of work against the member of the Consortium/Joint Venture. In case where distribution of Consortium/JV members is not specified in Consortium/JV agreement then the experience credential shall be considered for all members of JV with minimum 35% participation share.
3.2 E राजपत्र अधिसूचना- जीएसआर 127(ई) दिनांक 19.02.2019 या समय-समय पर संशोधित के अनुसार परिभाषा के अंतर्गत आने वाले समान प्रकृति के काम के लिए पंजीकृत सभी स्टार्टअप (चाहे एमएसई हों या अन्य) को पैरा 3.2 ए के अनुसार पूर्व अनुभव-पूर्व टर्नओवर के संबंध में योग्यता मानदंड को पूरा करने से छूट दी गई है, बशर्ते कि वे गुणवत्ता और तकनीकी विनिर्देश को पूरा करते हों। हालाँकि, नियोक्ता सार्वजनिक सुरक्षा, स्वास्थ्य, महत्वपूर्ण सुरक्षा संचालन और उपकरणों आदि से संबंधित वस्तुओं की खरीद जैसी परिस्थितियों के मामले में स्टार्टअप को ऐसी छूट देने से इनकार करने का अधिकार सुरक्षित रखता है।
All Startups (whether MSEs or otherwise) registered for similar nature of work falling within the definition as per Gazette notification- GSR 127(E) dated 19.02.2019 or as amended from time to time are exempted from meeting the qualification criteria in respect of Prior Experience-Prior Turnover as per para 3.2 A subject to their meeting the quality and technical specification. However, the Employer reserves the right to deny such exemptions to Startups in case of circumstances like procurement of items related to public safety, health, critical security operations and equipments etc.
- F दिवालियापन/Insolvency
ऐसे बिडर जिसके खिलाफ बीड प्रस्तुत करने समय कॉर्पोरेट इनसॉल्वेन्सी संकल्प कानूनी कार्यवाही स्वीकार नहीं किया गया है परंतु बीड मूल्यांकन के दौरान या वर्क अवार्ड करने से पहले आईबीसी 2016 के अंतर्गत निर्णायक प्राधिकार द्वारा ऐसा कोई आवेदन स्वीकार किया जाता है तो बिडर को अयोग्य मानते हुए उसकी बीड अस्वीकार कर दी जाएगी।
इसके लिए बिडर के अधिकृत प्रतिनिधित द्वारा लेटर हेड पर इस आशय का वचनपत्र देना होगा कि “बिडर के खिलाफ आईबीसी 2016 के अंतर्गत निर्णायक प्राधिकारी द्वारा इनसॉल्वेन्सी की कोई कानूनी कार्यवाही स्वीकार नहीं की गई है।”
इसके अतिरिक्त, बीड प्रस्तुत करने के बाद वर्क अवार्ड होने तक बिडर अपने खिलाफ आईबीसी 2016 के अंतर्गत निर्णायक प्राधिकारी द्वारा कॉर्पोरेट इनसॉल्वेन्सी संकल्प संबंधी कानूनी कार्यवाही की स्वीकृति की सूचना एनएचपीसी को देगा। ऐसे तथ्यों को छुपाए जाने पर बीड डॉक्युमेंट के टर्म एवं कंडीशन के अनुसार बिडर का बीड अविकार कर दिया जाएगा और उसके व्यापारिक व्ययवाहर के लिए प्रतिबंधित कर दिया जाएगा।
The Bidder against whom an application for initiating corporate insolvency resolution process has been admitted by the Adjudicating Authority under the Insolvency and Bankruptcy code 2016 or as amended from time to time shall not be eligible for bidding. The same shall also be applicable to the bidder company who has taken unconditional technical and/or financial support from their Parent/ Holding Company, against whom an application for initiating corporate insolvency resolution process has been admitted by the Adjudicating Authority under the Insolvency and Bankruptcy Code 2016, or as amended from time to time (IBC 2016 hereafter).
In case, bidder in respect of whom any application for initiating corporate insolvency resolution process was not admitted at the time of submission of bid but subsequently during the period of evaluation of bids or any time before the work is awarded, any such application is admitted by the Adjudicating Authority under the IBC 2016, the bidder shall be considered as ineligible and his bid shall be rejected.
An undertaking that “no insolvency proceedings is admitted by the Adjudicating Authority against bidder under the IBC 2016” shall be submitted on letter head duly signed by the authorized representative of bidder.
Further, the bidder after submitting the bid till the time of award of work, shall inform NHPC regarding any admission of application for corporate insolvency resolution process by the Adjudicating Authority under the IBC 2016 against bidder and any suppression of such fact shall render the bidder liable for rejection of his bid and banning of business dealing as per terms and conditions of the Bid Document.
3.3अनर्हता/ Disqualification:
उपर्युक्त अर्हता मानदंडों को पूरा करने के बावजूद बिडर को अयोग्य माना जाएगा यदि वे Even though the bidders meet the above qualifying criteria, they are subject to be disqualified if they have:
- अहर्ता अपेक्षाओं के प्रमाणस्वरूप यदि वे फॉर्म, विवरण, वचनपत्र, घोषणा और संलग्नकों में भ्रामक या गलत जानकारी दिए हैं, और / या
- इसी प्रकार के कार्य हेतु पूर्व बीडींग में भाग लिए लेकर एल-1 आएं हों और असामान्य रूप से उच्च या न्यून दर कोट करने का उचित औचित्य नियोक्ता को नहीं दे पाए हों।
- ऐसे बिडर जिनका कान्ट्रैक्ट नियोक्ता द्वारा असंतोषजनक कार्यनिष्पादन हेतु पूर्व में समाप्त कर दिया गया हो वे अपात्रता अवधि पूरा होने से पहले बीडींग में भाग नहीं ले सकते हैं। ऐसी स्थिति में बीड को गैर-उत्तरदायी / नॉन-रेसपॉनसीव माना जाएगा।
4.0 Time for Completion
सफल बिडर क्रम संख्या-1 में उल्लिखित समय सीमा के समस्त कार्य पूरा करेगा जिसकी गणना नियोक्ता द्वारा स्वीकृति पत्र जारी करने की तिथि से की जाएगी।
The successful bidder shall complete the entire work within the time specified at SI no. -1, to be reckoned from the date of issue of Letter of Acceptance issued by the Employer.
5.0 निविदाओं के साथ तालिका में कार्य के लिए निर्दिष्ट राशि की बयाना राशि भी संलग्न होनी चाहिए।
Tenders must be accompanied by the earnest money of the amount specified for the work in the table.
6.0बीड पूर्व बैठक /Pre-Bid Meeting
- यदि आवश्यक हो, तो सभी संभावित बोलीदाताओं के लिए खुली एक पूर्व-बोली बैठक क्रम संख्या-1 के अनुसार स्थान, तिथि और समय पर आयोजित की जाएगी, जिसमें उन्हें कार्य और बोली की शर्तों के संबंध में स्पष्टीकरण, यदि कोई हो, प्राप्त करने का अवसर दिया जाएगा।
- संभावित बोलीदाता अपने प्रश्न, यदि कोई हों, तो ई-मेल/कूरियर द्वारा एनआईटी के पैरा-1(ए)(ix) में उल्लिखित पते पर बोली-पूर्व बैठक से कम से कम 03 दिन पहले प्रस्तुत कर सकते हैं, ताकि बैठक के दौरान उनका उत्तर दिया जा सके।
7.0बीड प्रस्तुतीकरण /Bid submission
- ऑनलाइन बोली प्रस्तुति - तकनीकी बोली (कवर-I) (खंड-II अर्थात आईटीबी देखें) और मूल्य बोली (कवर-II) इलेक्ट्रॉनिक प्रारूप) सभी प्रकार से पूर्ण होकर एसआई संख्या 1 के अनुसार निर्दिष्ट तिथि और समय से पहले उपरोक्त पोर्टल पर अपलोड की जानी चाहिए।
- ऑफलाइन बोली प्रस्तुतीकरण (धारा-II अर्थात आईटीबी देखें) को सभी तरह से पूर्ण करके सीलबंद लिफाफों में पते पर एसआई. क्रमांक 1 के अनुसार निर्दिष्ट तिथि और समय तक पहुंचाना होगा।
यदि बोलियों को प्रस्तुत करने के लिए निर्दिष्ट तिथि या संशोधन यदि कोई हो, को नियोक्ता के लिए अवकाश घोषित किया जाता है, तो दस्तावेजों की हार्ड कॉपी अगले कार्य दिवस को निर्दिष्ट समय तक प्राप्त की जाएगी। इसी तरह, यदि बोलियों को खोलने के लिए निर्दिष्ट तिथि या संशोधन यदि कोई हो, को नियोक्ता के लिए अवकाश घोषित किया जाता है, तो बोली को अगले कार्य दिवस को निर्दिष्ट समय पर खोला जाएगा। हालाँकि, बोलियों को ऑनलाइन प्रस्तुत करने की तिथि और समय निर्दिष्ट तिथि और समय या संशोधन यदि कोई हो, के रूप में जारी रहेगा।

In the event of the specified date or amendment if any for the submission of bids being declared a holiday for the Employer, the hard copy of the documents will be received up to the specified time on the next working day. Similarly, in the event of the specified date or amendment if any for the opening of bids being declared a holiday for the Employer, the opening shall be carried out at the specified time on the next working day. However, the date and time for online submission of the Bids shall continue to be the date and time specified or amendment if any.
8.0 बोली के लिए मुद्रा केवल भारतीय रुपया होगी।
The currency for the Bid shall be Indian Rupee only.
9.0 बोलियाँ बोली प्रस्तुत करने की अंतिम तिथि के बाद क्रम संख्या 1 में उल्लिखित अवधि के लिए वैध होंगी। यदि कोई बोलीदाता उक्त अवधि से पहले अपनी बोली वापस लेता है या अपनी बोली में कोई संशोधन करता है, तो बोलीदाता की बयाना राशि जब्त कर ली जाएगी। बोली वैधता अवधि समाप्त होने से पहले, नियोक्ता बोलीदाताओं से बोली वैधता अवधि बढ़ाने का अनुरोध कर सकता है। अनुरोध और प्रतिक्रिया लिखित रूप में की जानी चाहिए। बोली वैधता अवधि का विस्तार बोलीदाता को अपनी बोली संशोधित करने का अधिकार नहीं देगा। यदि बोलीदाता नियोक्ता के अनुरोध पर बोली वैधता बढ़ाने में विफल रहता है, तो संबंधित बोली को गैर-उत्तरदायी मानकर अस्वीकार कर दिया जाएगा।
Bids shall be valid for a period as mentioned in Sl no. 1 after the deadline for Bid submission. If any Bidder withdraws his Bid before the said period or makes any modification in his Bid, the Earnest Money deposit of the Bidder shall be forfeited. Prior to the expiry of bid validity period, Employer may request Bidders to extend the Bid validity period. The request and the response shall be made in writing. An extension of the bid validity period will not entitle a Bidder to modify its Bid. In case Bidder fails to extend the bid validity upon employer’s request, the corresponding Bid shall be rejected as being non-responsive.
10.0 तकनीकी-वाणिज्यिक बोली क्रम संख्या-1 के अनुसार स्थल की तिथि और समय पर ऑनलाइन खोली जाएगी। योग्य बोलीदाताओं की वित्तीय बोली खोलने का समय और तिथि तकनीकी बोलियों के मूल्यांकन के बाद बाद में पोर्टल के माध्यम से सूचित की जाएगी। नियोक्ता/निविदा आमंत्रित करने वाला प्राधिकारी अपने विवेक से तकनीकी और वित्तीय बोली एक साथ खोल सकता है और बोली का पूर्ण मूल्यांकन कर सकता है।
The Techno-commercial Bid shall be opened online at venue date & time as per Sl. No.-1. the time and date of opening of Financial Bid of bidders qualified the technical bid shall be communicated through portal at later date after evaluations of technical bids. The Employer/Tender inviting Authority at his discretion may open Technical and Financial Bid simultaneously and evaluate the Bid completely.
11.0 नियोक्ता राष्ट्रीय सुरक्षा के मद्देनजर संवेदनशील क्षेत्र और सीमावर्ती क्षेत्रों में स्थित परियोजना में किसी भी रूप में भाग लेने वाली विदेशी कंपनियों और उनके कर्मचारियों पर कुछ प्रतिबंध लगा सकता है। नियोक्ता को ऐसी कंपनी की योग्यता निर्धारित करने से पहले सुरक्षा निहितार्थों के बारे में भारत सरकार से मंजूरी लेनी होगी। इसके अलावा, भारत के साथ भूमि सीमा साझा करने वाले देशों के बोलीदाताओं को व्यय विभाग, वित्त मंत्रालय, भारत सरकार के कार्यालय ज्ञापन संख्या F.No. 6/18/2019/PPD दिनांक 23.07.2020 और 24.07.2020 का अनुपालन करना होगा।
The Employer may impose certain restrictions on the foreign companies participating in any form and their employees in view of the National Security, in the Project situated in the sensitive region and border areas. The Employer shall obtain clearance of Govt. of India regarding security implications prior to qualification of such company. Further, bidders from countries, which share land border with India, shall comply with Department of Expenditure, Ministry of Finance, GoI, OM No. F.No. 6/18/2019/PPD dt. 23.07.2020 & 24.07.2020.
12.0 बोलियाँ प्रस्तुत करने के लिए कोई भी शुद्धिपत्र, बाद में संशोधन और / या तिथि का विस्तार, यदि कोई हो, पोर्टल https://eprocure.gov.in/eprocure/app पर पोस्ट किया जाएगा। बोलीदाताओं को सलाह दी जाती है कि वे बोलियाँ प्रस्तुत करने की अंतिम तिथि से पहले नियमित रूप से पोर्टल पर जाएँ।
Any corrigendum, subsequent amendments and / or extension of date, if any, for submission of Bids shall be posted on the portal https://eprocure.gov.in/eprocure/app. Bidder(s) are advised to visit the portal regularly before the deadline for submission of Bids.
13.0 नियोक्ता किसी भी बोली को स्वीकार या अस्वीकार करने तथा बोली प्रक्रिया को रद्द करने और सभी बोलियों को अस्वीकृत करने का अधिकार सुरक्षित रखता है, अनुबंध दिए जाने से पहले किसी भी समय, प्रभावित बोलीदाता या बोलीदाता(ओं) के प्रति कोई दायित्व वहन किए बिना। हालाँकि, जो बोलीदाता(ओं) रद्दीकरण/अस्वीकृति के ऐसे निर्णय के लिए कारण जानना चाहते हैं, उन्हें नियोक्ता द्वारा इसकी सूचना दी जाएगी, जब तक कि इसके प्रकटीकरण से भारत की संप्रभुता और अखंडता, राज्य की सुरक्षा, रणनीतिक, वैज्ञानिक या आर्थिक हित प्रभावित होने या किसी अपराध को बढ़ावा देने की संभावना न हो।
The employer reserves the right to accept or reject any Bid and to cancel the Bidding process and reject all Bids, at any time prior to the award of Contract, without thereby incurring any liability to the affected Bidder or Bidder(s). However, the Bidder(s) who wish to seek reasons for such decision of cancellation/rejection shall be informed of the same by Employer unless its disclosure reasonably could be expected to affect the sovereignty and integrity of India, the security, strategic, scientific or economic interest of the state or lead to incitement of an offence.
